Exemption from the Payment of Renewal Fees for Patents for the First Five Years and for Utility Models for the First Three Years
Renewal fees for national and European patents
General information::
Renewal fees for patents must be transferred or deposited within three months before the due date of payment.
Renewal fees may also be paid up to a maximum of six months after the due date. Payments made after the due date, however, must include the renewal fee plus a 20 % surcharge. If the renewal fee is not paid within this period of grace, the patent will lapse.
National patents that were issued before 1 July 2005 and patent applications for which the publication decision was made before
1 July 2005
Renewal fees must be paid every year in advance, beginning with the date of publication of the application in the Patent Gazette.
The due date of renewal fees is determined by the date of publication.
National patents granted after 1 July 2005
Renewal fees must be paid every year in advance, beginning with the sixth year after grant (counted from the last day of the application month). The due date of renewal fees is determined by the application date of the patent.
Renewal fees are always due on the last day of the application month.
If the granting process takes longer than five years, renewal fees only have to be paid for the years following the grant of the patent.
European Patents
The due date of payment and the amount of the renewal fees of all European patents are determined based on the same principles as for national patents granted after 1 July 2005 (see above).
For European patents granted before 1 July 1996, renewal fees are adjusted insofar as the renewal fee is now calculated based on the full term of the patent (counted from the application date).

Renewal fees for utility models must be transferred or deposited within three months before the due date of payment.
Renewal fees may also be paid up to a maximum of six months after the due date. Payments made after the due date, however, must include the renewal fee plus a 20 % surcharge. If the renewal fee is not paid within this period of grace, the utility model will lapse.
Renewal fees must be paid every year in advance, beginning with the fourth year after registration (counted from the last day of the application month).
The due date of renewal fees is determined by the date of application of the utility model. Renewal fees are always due on the last day of the application month.
If the granting process takes longer than three years, renewal fees only have to be paid for the years following the grant.
Instead of annual renewal fees, it is possible to pay flat-rate fees for the 4th to 6th years and for the 7th to 10th years. The due date for the payment of flat-rate fees corresponds to the due date of the fourth and seventh renewal fee, respectively.
